Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out the rules for using the Aibilo outbound calling platform. It applies to all Users and forms part of our Terms of Service. Violations may result in suspension or termination of your Account.
1. Permitted Uses
You may use Aibilo to make legitimate outbound calls for business purposes, including:
- B2B sales outreach to prospects with whom you have a pre-existing business relationship or who have opted in to receive calls.
- Customer success and support follow-up calls.
- Recruitment outreach to candidates who have applied or consented to be contacted.
- Appointment confirmation and reminder calls.
- Other professional communications in compliance with applicable laws.
2. Prohibited Uses
You must not use Aibilo to:
- Make unsolicited mass calls (spam calling) to contacts who have not consented or with whom there is no legitimate business relationship.
- Call numbers listed on a Do Not Call (DNC) registry — national or industry-specific — unless you have a valid, documented exemption.
- Harass, threaten, intimidate, or abuse called parties.
- Misrepresent your identity, company, or the purpose of the call.
- Call outside permitted hours for the recipient's local timezone. As a general guide, calls should be placed between 08:00 and 21:00 local time, consistent with TCPA (USA) and equivalent local regulations.
- Facilitate or engage in fraud, phishing, scams, or any illegal activity.
- Attempt to reach emergency services (911, 112, 999, etc.) through the platform.
- Circumvent technical restrictions or attempt to gain unauthorised access to any part of the Service.
- Resell or sublicence access to the Service to third parties without our written consent.
3. AI Autonomous Caller — Additional Rules
When using the AI Caller feature you must also comply with the following:
Disclosure requirement
Where required by applicable law (including California AB 2602, the TRACED Act, and equivalent legislation in other jurisdictions), you must configure the AI to disclose at the beginning of each call — clearly and promptly — that the called party is speaking with an automated AI system and not a human.
No impersonation of real persons
You must not configure the AI to impersonate a specific, identifiable real person in a way that could deceive called parties about who they are speaking with.
Legal basis for contacting
You must have a valid legal basis — prior consent, a legitimate business relationship, or other applicable exemption — for each individual contact in your campaign.
Opt-out compliance
You must configure the AI to recognise and honour opt-out requests during the call. Contacts who opt out must be immediately removed from future campaigns. Do not retry opted-out contacts.
Legally sourced contact lists
All contact lists used in AI Caller campaigns must be legally obtained. You must not upload data scraped in violation of platform terms of service, purchased from unlicensed data brokers, or otherwise acquired in breach of data protection laws.
Prohibited industries for AI calling
AI Caller campaigns are prohibited in the following industries without additional documentation establishing regulatory compliance:
- Debt collection (requires appropriate licensing under applicable law)
- Financial services solicitation (requires regulatory authorisation)
- Healthcare solicitation without proper patient consent
- Gambling or betting in jurisdictions where such solicitation is restricted
- Political robocalling in jurisdictions where regulated
4. Call Recording Rules
If you enable call recording:
- You must inform all parties being recorded where required by law.
- You must not record calls in jurisdictions where recording is prohibited.
- All-party (two-party) consent is required in, among others: California, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, and Washington (USA); and under more stringent member-state laws in Germany, France, and other EU countries.
- You are solely responsible for determining and complying with recording laws in every jurisdiction where your calls terminate.
5. Data and Contact Lists
- Contact data you upload must be legally sourced and collected in compliance with applicable privacy laws (GDPR, CCPA, etc.).
- Do not upload data obtained through unlawful means or in violation of any third-party terms of service.
- Maintain and honour a suppression list of individuals who have opted out or requested not to be contacted.
- Retain documentation of consent or legitimate interest for contacts, and make it available to Aibilo on request.
6. Consequences of Violation
We take AUP violations seriously. Depending on the severity and frequency of the violation, we may:
- Issue a warning and require remediation
- Suspend your Account pending investigation
- Permanently terminate your Account without refund
- Report violations involving illegal activity to relevant law enforcement authorities or regulators
You remain solely liable for any damages, fines, or penalties arising from your violation of this AUP or applicable law.
7. Reporting Abuse
If you believe another user is violating this AUP or using Aibilo for illegal purposes, please report it to us immediately at info@aibilo.io. We will investigate all credible reports.
